In this 2015 ruling by the National Green Tribunal’s Pune branch, the Court strikes down an original application to prevent hill-clearing upon the appeal of the responsible company. The Court reaches this conclusion on the basis that the company had not, in fact, exceeded its original permission for land clearance, and on the basis that the original petitioner (Sayed Tayeeb) failed to bring a case before the NGT within the requisite 10-month period after the observance of the alleged environmental infraction. This case demonstrates the limitations of the NGT Act with regard to legal proceedings against alleged environmental infractions.
